The following terms and conditions apply to MSC Plus loyalty program (the Program) and provide relevant information about various aspects of the Program. Any participation to the program means that the participant read and unconditionally accepted the terms and conditions below.

La Carte Plus is strictly personal and individual and may not be transferred, loaned, sold to any person or used for purposes other than those defined below.

Obtaining La Carte Plus:

• Any MSC Plus client may join the Program free of charge.
• Joining the Program is not mandatory, and having an account “La Carte Plus” is not an obligation to do business with MSC Plus.
• To join the Program, each client shall complete a registration form and provide the required information and identification documents.
• MSC Plus will be able to issue cards for the clients already registered in its system.
• Each client can only hold one La Carte Plus.
• MSC Plus reserves the right to refuse La Carte Plus to any client who has not provided the required information and/or identification documents.

Accumulation of points

• La Carte Plus allows to accumulate points when purchasing at MSC Plus, either at the Tabarre store or the Cap-Haïtien one.
• 5% of all purchases made excluding the turnover tax and in gourdes (HTG) or its equivalence in HTG will be earned in the form of points.
• Each point equals HTG 1.00
• The points earned can only be whole points and not partial points, and the points will be rounded down (for example a purchase of HTG 6,000 will earn 272 points).
• The points will appear on the invoice at the time of payment and on any other source of information to which MSC Plus links it.
• The points may be earned without the physical loyalty card (La Carte Plus) as long as the client’s identity can be verified.
• The points are earned within 24 hours of the purchase by the client, provided that the purchase is fully paid for in cash, credit card or verified check; the purchases made with MSC Plus credit don’t earn points.
• The returns result in the deduction of the points from the client’s account; however, if a client has already used all of their points and that the return would result in a negative balance of their credit account, the transaction will be blocked, and a store manager will determine if the item may be exchanged for an item of the same price or if a store credit may be provided for the amount of the points used.
• The exchanges will not affect the balance of the loyalty account, unless the exchange results in a net change in the amount paid for the item(s).

Use of points

• The points can only be used at MSC Plus.
• The points can only be used for purchases in full and in no case for partial purchases (i.e. if the total cost of the purchase is 20 HTG, and the client only have 18 points, then some items must be removed in order for them to fall under HTG 18, the remaining 2HTG may be invoiced separately).
• The client’s identity must be verified and therefor, they must show a valid identification card which matches the information of MSC Plus’s system (NIF, CIF).
  
• Any return of items bought with points will result in a deduction of points from the account, and under no circumstances will a cash credit be made to the client.

Transfer and pooling of points

• Points transfer is not allowed.
• Points pooling is not allowed.

Monetary value

• There’s no withdrawal value for the points under no circumstances and the points can in no case be converted to cash.

Expiration date

• The points don’t have an expiration date, however, MSC Plus reserves the right at any time to terminate the Program or modify the terms and conditions in whole or in part without notice.

Damages or loss of the physical card

• For the lost or damaged cards, MSC Plus will only issue replacement cards upon the client’s request and for the cost of HTG 500/card.
• In case of a lost, stolen or damaged of La Carte Plus, MSC Plus shall not be held liable, including for the fraudulent use of the points and benefits by a third party. It is expressly stated that MSC Plus does not automatically verify the identity of the holder of La Carte Plus and it is the client’s responsibility to keep their card in a safe place and notify MSC Plus in case it’s lost or stolen.
• At the discretion of MSC Plus, the client may be assigned a different account number and in this case the balance of the initial account will be transferred on the new account.

Disclaimer and notes:

• MSC Plus is exonerated from any responsibility for the direct and indirect consequences of any anomalies and malfunctions of La Carte Plus regardless of their causes. MSC Plus will nevertheless do its best efforts to keep for each participant to the Program, in case of malfunction, the benefits of their accumulation of points and its advantages.
• MSC Plus, La Carte Plus, Programme de Fidélité MSC Plus (MSC Plus loyalty program), are all registered by MSC Plus and can’t be reproduced.
• By joining the Program, the account holder authorizes MSC Plus to send solicitations and correspondences via electronic and physical channels, including the public use of some account holder’s names (but not the private information such as the NIF or CIF) for some promotional purposes.
• The loyalty account is not a credit account and can only be used for the purposes of accumulating and using the points as part of the MSC Plus loyalty program.
• Each client can only have one loyalty account.
• MSC Plus reserves the right to modify any aspect of the Program at its sole discretion to:

1. 1. Change the Program
   2. Cancel the Program
   3. Terminate specific accounts due to mismanagement and irregularities found

• MSC Plus holds all client’s accounts securely and uses an authentication program to confirm the client’s identity, however there’s always a risk of hacking, for which MSC Plus can’t be held liable.

The terms and conditions of the Program are subject to the laws and rules in force in the Republic of Haiti.
